Terms of Service

These Terms of Service ("Terms") govern your use of https://penncasso.com (the "Site") and your purchase of products through it, operated by PennCasso, Custom Pen Maker ("PennCasso," "we," "us"). By using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.

Use of the Site

We grant you a limited, non-exclusive, revocable license to access and use the Site to browse our handmade pens, place orders, and contact us. You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms.
  • Attempt to gain unauthorized access to the Site, its servers, or connected systems.
  • Scrape, copy, or republish Site content or product photography at scale without written permission.
  • Submit forms or orders with false information or use automated tools to do so.
  • Interfere with the Site's operation, checkout, or security features.

Products and Handmade Variation

Our pens are handmade from natural materials such as wood, resin, and metal. Because each piece is made by hand, the grain, color, and finish of the pen you receive may vary slightly from the photographs on the Site. These natural variations are a feature of a handmade product, not a defect. We do our best to photograph and describe every item accurately, but colors can also appear differently across screens.

Orders, Pricing, and Payment

  • Placing an order is an offer to buy. Your order is accepted when we confirm it and begin preparing it for shipment. We may decline or cancel an order — for example, if an item is out of stock, a price was listed in error, or we cannot verify payment — and if we do, we will not charge you or will refund any amount already charged.
  • Prices are shown in U.S. dollars and may change at any time before you place an order. Applicable taxes and shipping are calculated at checkout.
  • Payment is processed securely by our payment processor at checkout. By submitting an order you represent that you are authorized to use the payment method provided.
  • Custom and personalized orders may be arranged by email and confirmed in writing before we begin. Because they are made specifically for you, custom orders may not be cancelable once production has started.

Shipping and Delivery

We ship within the timeframe noted at checkout or in your order confirmation. Delivery dates are estimates, not guarantees, and can be affected by the carrier, weather, or other events outside our control. Risk of loss passes to you when the carrier takes possession of your order. If your order arrives damaged, contact us promptly so we can make it right.

Returns and Refunds

If you are not happy with a stock (non-custom) pen, contact us at lrocha@penncasso.com within a reasonable time after delivery and we will work with you on a return, exchange, or refund. Custom and personalized items are generally not returnable except where they arrive damaged or defective. Nothing here limits any rights you have under applicable consumer-protection law.

Intellectual Property

The Site and its content — text, product photos, graphics, logos, and design — are owned by PennCasso, Custom Pen Maker or used under license, and are protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works from Site content without our written permission, except for brief excerpts with attribution or as otherwise allowed by law. Your Submissions

When you submit information through the Site — a message, an order, or a shipping address — you represent that it is accurate, that you have the right to share it, and that any email address you provide belongs to you or you are authorized to use it. How we handle submitted information is described in our Privacy Policy.

Limitation of Liability

The Site is provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent permitted by law, PennCasso, Custom Pen Maker will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or the products you buy, including lost profits, lost data, or business interruption — even if we have been advised of the possibility of such damages. Our total liability arising from your use of the Site or any order will not exceed the amount you paid for the product at issue. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnification

You agree to indemnify and hold harmless PennCasso, Custom Pen Maker and its owners, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.

Governing Law

These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict of law rules. Any dispute arising from these Terms, your use of the Site, or your purchase will be brought in the state or federal courts located in Oklahoma, and you consent to their jurisdiction.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. Your continued use of the Site after a change means you accept the updated Terms.
